A South Carolina couple is suing a Myrtle Beach resort for chemical burns the husband received after entering the facility’s hot tub.
The complaint, entered in the South Carolina County of Horry Court of Common Pleas on October 25, states that Jeff and April Miller were guests at the Myrtle Beach Sea Mist Resort in October of 2020 when Jeff Miller entered the hot tub and received chemical burns to his body.
The lawsuit accuses the resort of reckless, wanton, or grossly negligent conduct.
According to court documents, “As a result of the negligence of the defendants, individually or jointly, Mr. Miller suffered chemical burns to his chest down to his lower legs, including his genitals, resulting in a visit to Urgent Care for examination and treatment, and resulting in excruciating and debilitating pain and discomfort, which interfered with his quality of life, activities of daily living and which caused anxiety, grief, and suffering.”
Additionally, the suit states that April Miller “suffered the loss of consortium of her husband.”
As a result of his injuries, the complaint states, Miller “incurred medical treatment, experienced pain and suffering, experienced severe physical injuries, incurred medical expenses, experienced mental anguish and distress, experienced alteration of lifestyle, loss of level of function, loss of enjoyment of life, and loss of earnings and income.”
In addition to the resort, the suit also names Carolinas Holding Co., a real estate development firm, and Shiv of SM, a real estate investment firm, as defendants.
The suit alleges the hot tub’s chemical levels posed an unreasonably hazardous condition and accuses those named in the suit of failing to keep the hot tub safe and violating safety regulations of the South Carolina Department of Health and Environmental Control.
The Millers are seeking a jury trial to award them compensation for medical bills, loss of earnings and income and other damages.
