A New Jersey Man is suing a waterpark after a decorative prop fell from the ceiling and injured him while he was swimming.
The incident occurred at the indoor DreamWorks Water Park in February 2023, in Bergen County, when a suspended helicopter suddenly dropped into the pool. At least four people were injured, including Luis Rivera, 55, who brought the suit.
According to a report from the New Jersey State Police, Rivera was taken to the hospital following the incident.
The complaint states that Rivera suffered “great pain, mental anguish, and financial loss; was required, and will in the future be required, to seek medical care and attention; was prevented, and will in the future be prevented, from engaging in his usual pursuits, interests, and occupations.”
The suit names the owners of the waterpark, as well as six additional defendants, including the construction management company, the cable supplier, the waterpark designer, the architect, and others for negligence in failing to install, inspect, and maintain the cables holding the helicopter.
Following the incident, an inspection of the hanging decorations at the DreamWorks Water Park found that two additional structures posed public threats. One was a hanging tree branch and another was a suspended penguin dangling from a parachute. In the case of the penguin, the report concluded that the cables are “exhibiting deterioration” and “the cables within the element are not in serviceable condition.”
Rivera’s suit, which was filed in the Bergen County Superior Court on November 11, is seeking a jury trial.
